“This is not the first time Disney has been sued for breached contracts,” said Rachel Hynes, a former lawyer who worked on behalf of non-union background actors in a class-action lawsuit against Disney for alleged “churning” or excessively rotating workers. “There was a lawsuit brought by extras on the first Avengers film who said they worked 12-plus hours per day and weren’t paid, but there were others as well that went through private arbitration.
I think a lot of people look at this behemoth [Disney] and think it’s untouchable, but everyone needs to follow their contracts; you need to read your contracts,” she told Deadline. With The Walt Disney Studios and Marvel Entertainment under the same roof, Johansson’s argument is that her role should have been transferred back when Marvel was purchased by Disney in 2009. It’s been three years since the comic house was purchased by Marvel Entertainment, and Johansson is claiming that her contact with Disney has expired. If she’s successful in the lawsuit, it would mean that future studios could bring new characters to life through other means—such as Netflix or Hulu—rather than rely on a single distribution company.
Johansson’s lawyer issued a statement to Deadline claiming that “Disney is using Marvel as an excuse to breach her contract. She believes that if she’s successful in getting the release, she’ll be able to act in other franchises with different studios.” In response, Disney commented that it was still not party to a lawsuit—yet—but would “vigorously defend against this action.” This isn’t the first time that Johansson has sued a production company for allegedly being short-changed on profits. Last year, she filed suit against Rupert Murdoch’s empire 21st Century Fox for failing to share revenue from ads featuring her image and directed toward mobile devices. Johansson’s lawsuit comes at an interesting time for Marvel Studios. Its parent company Disney is currently being sued by Michael Donnelly, a visual effects employee who claims the studio made him train his foreign replacement. Donnelly had been working on the editing software to make scenes involving monsters like Groot and Rocket Racoon from Guardians Of The Galaxy; he says that Disney replaced him with workers from India in May 2014. The court made a big step toward Disney’s side when it granted summary judgment in favor of all defendants except former VP of visual effects Vanessa Morrison, who allegedly complained about the use of an outsourcing firm without informing Donnelly or other employees.
“We disagree with [the ruling] because we believe we acted lawfully,” said a Disney spokesperson. “We’re considering our options.” The Donnelly case is set to go to trial in November.
Disney has also been hit with a motion for class certification from former interns who claim that the multi-billion dollar company violated federal and state labor laws by not paying them minimum wage or overtime compensation for hours worked. Earlier this year, fashion interns who worked on The Devil Wears Prada and Black Swan won their lawsuit against Fox Searchlight Pictures. They were awarded $700,000 in unpaid wages in June.
Deadline reached out to Disney’s legal team for a comment, but did not hear back by publication time. Johansson is represented by Melanie Cook of Cook Genow Lewis in Los Angeles. The actress has been busy promoting her latest film Ghost In the Shell and The Jungle Book with Idris Elba and Bill Murray, set to hit theaters on April 15 and 18, respectively.
